In May last year, Mr Cantali began AVO proceedings against Strathfield Triangle developer Antoine Bechara. Mr Cantali had alleged in Burwood Court last June that Mr Bechara had threatened him outside the council chambers the previous February. A magistrate refused to grant an interim order but set down a hearing for August 19 and 21 to decide whether a full order should be made. In July, Mr Cantali withdrew the application and on August 4 was ordered to pay more than $6000 in costs. Mr Bechara's legal team had sought $19,000 in costs. But magistrate Michael Dakin said the claim was ''reasonably excessive'' given the factual and legal issues in the case ''did not appear to be complex''. He ordered Mr Cantali pay $5170 for Mr Bechara's legal costs for the week leading up to their June 20 court appearance and a further $1125 for that day's proceedings. However, Mr Bechara pur- sued the matter by taking Mr Cantali to court. In the District Court in December, Judge L Levy or- dered that both parties take part in a mediation before February 13, 2009, and for the costs to be shared. The mediation was held on February 9 and Mr Bechara was represented by high-profile QC Stuart Littlemore. While no settlement was reached, an offer of $20,000 in damages, $45,000 in costs and an agreed apology was left open for a week for Mr Cantali to con- sider. On February 16, Mr Cantali's legal team contacted Mr Bechara's representatives to ac- cept the offer. The terms of the settlement were filed in the District Court on February 20. Mr Cantali's apology read in part: ''Prior to the AVO being finalised I withdrew the AVO application. As a consequence any allegations made by me were not proven. In the circum- stances I apologise for any hurt and distress I may have cause Mr Bechara and his family.'' Mr Bechara said this week: ''His apology says it all.'' Mr Cantali declined to com- ment.
